This distance sales contract is concluded between Juguetes Donaire (hereinafter, the “Seller”) and the person placing the order (hereinafter, the “Customer”), in accordance with Spanish Royal Legislative Decree 1/2007 of November 16, approving the consolidated text of the General Law for the Protection of Consumers and Users.
The products sold by the Seller may include vintage, discontinued, collectible, or old stock items. Therefore, although they may be in their original packaging, the Customer acknowledges that certain products may show signs resulting from the passage of time, their age, storage conditions, or the nature of the item itself.
Unless expressly stated otherwise in the product description, items are sold in their original packaging and have not been opened or handled by the Seller. The preservation of the original packaging may be relevant for collectible items, and therefore the Seller will not open it unless expressly requested by the Customer through the purchase of the product condition checking service.
The Customer may optionally purchase a product condition checking service, where available. This service consists of opening the original packaging in order to verify, as far as reasonably possible, the general condition and functionality of the product prior to shipment.
By purchasing this service, the Customer acknowledges that the original packaging will be opened and the product handled solely for inspection purposes. Once the check has been carried out, the Seller will inform the Customer of the product's condition, allowing the Customer to decide whether to proceed with the shipment or cancel the order.
The fee for the condition checking service corresponds to a service already performed and is non-refundable once completed, except where required by applicable law.
The Customer may place an order through the Website by selecting the desired products and following the indicated checkout process. Once the order is placed, the Customer will receive an email acknowledging receipt of the order.
Final acceptance of the order is subject to actual product availability, successful payment processing, and the absence of manifest errors in price, stock, product description, or shipping costs. The Seller reserves the right to cancel or reject the order prior to shipment for justified reasons, informing the Customer and issuing a full refund if applicable.
All prices displayed on the Website include applicable VAT and are expressed in euros (€). The Seller accepts the following payment methods: PayPal and bank transfer. Payment is charged at the time of order confirmation or according to the selected payment method.
The Seller makes every effort to ensure that prices, stock availability, product descriptions, and shipping costs displayed on the Website are accurate. However, occasional errors or technical discrepancies may occur. In the event of an obvious error, stock unavailability, or inability to fulfill the order under the stated conditions, the Seller may cancel the order before shipment, informing the Customer and refunding any amounts paid.
Shipping is available to mainland Spain, the Balearic Islands, the Canary Islands, and major European countries. Estimated delivery times are 3 to 7 business days for mainland Spain and 7 to 15 days for international shipments, subject to external circumstances or logistical issues.
Shipping costs are calculated based on destination, weight, volume, and available carriers, and will be displayed before confirming the purchase.
The Customer has the right to withdraw from the contract within 14 calendar days from receipt of the order, without giving any reason, in accordance with applicable consumer protection laws. To exercise this right, the Customer must notify the Seller in writing at info@juguetesdonaire.com.
The Customer must return the product in the same condition in which it was received, including, where applicable, original packaging, accessories, instructions, and any included items. The Customer shall be liable for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.
The direct costs of returning goods shall be borne by the Customer, unless otherwise required by law or expressly agreed by the Seller. Refunds will be issued within 14 calendar days from the date the withdrawal is communicated, although the Seller may withhold the refund until the goods are received or proof of return is provided.
The right of withdrawal does not apply to additional services already performed with the Customer’s prior consent, such as the condition checking service, once such service has been completed.
Products are covered by the legal warranty in accordance with applicable law. In the case of second-hand, vintage, discontinued, or collectible items, and where clearly stated in the product description or these terms, the warranty period may be limited to 1 year from delivery, as permitted by law.
Lack of conformity shall not include issues arising from the known age of the product, its collectible nature, normal wear and tear, storage conditions, or characteristics that were clearly disclosed to the Customer prior to purchase.
In the event of a defective or non-conforming product, the Customer must contact the Seller at info@juguetesdonaire.com, providing a description of the issue and, where possible, supporting images or videos. The Seller will proceed, as appropriate and in accordance with applicable law, with repair, replacement, price reduction, or contract termination.
Where the product has been purchased without the condition checking service, the Customer acknowledges that the Seller has not opened or tested the product prior to shipment in order to preserve its original packaging. This does not limit the Customer’s legal rights but will be considered when assessing the nature of the product and the origin of any issue.
For any inquiries, issues, returns, or complaints, the Customer may contact the Seller at info@juguetesdonaire.com. The Seller will aim to respond as quickly as possible and provide an appropriate solution in accordance with applicable regulations.
These General Terms and Conditions of Sale are governed by Spanish law and applicable European consumer protection regulations.
